DMCA Policy

Strawberry Waffles is committed to respecting the intellectual property rights of others. We comply with the provisions of the Digital Millennium Copyright Act (DMCA) and expect our users to do the same. This policy outlines the procedures for reporting copyright infringement and for responding to such reports.

Filing a DMCA Infringement Notification

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on Strawberry Waffles' services, please send a written DMCA notice to our designated Copyright Agent. For your notice to be effective under the DMCA, it must include substantially the following:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  2. Identification of the infringing material: A description of the material that you claim is infringing and where it is located on our service (e.g., URL(s)).
  3. Your contact information: Your address, telephone number, and email address.
  4. A statement of good faith belief: A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy and authority: A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Your physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a DMCA Counter-Notification

If you believe that material you posted on Strawberry Waffles was removed or disabled by mistake or misidentification, you may send a counter-notification to our Copyright Agent. For your counter-notification to be effective under the DMCA, it must include substantially the following:

  • Identification of the removed material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL(s)) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number: Your name, address, and telephone number.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Strawberry Waffles may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature: Your physical or electronic signature.
